1. Acceptance of Terms

By accessing or using Subh Mangal Milan (the "Platform") — including our website, mobile application, or any related services — you agree to these Terms of Service ("Terms") and our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement between you and Subh Mangal Milan Pvt. Ltd. ("Company", "we", or "us").

2. Eligibility

To use the Platform you must:

• Be at least 18 years of age.
• Be legally eligible to marry under the laws of your country/state of residence.
• Not be currently married (unless registering as divorced, widowed, or awaiting divorce, in which case the relevant status must be accurately disclosed).
• Have the legal capacity to enter into a binding contract.
• Not have been previously banned from the Platform.

By registering, you represent and warrant that all of the above conditions are met. We reserve the right to verify eligibility and to terminate accounts where eligibility cannot be confirmed.

3. Account Registration

3.1 Accurate Information

You must provide accurate, current, and complete information during registration and keep your profile up to date. Providing false information — including age, marital status, profession, or photographs — is a serious violation and may result in immediate account termination.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@subhmangalmilan.com if you suspect unauthorised access.

3.3 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts is prohibited and may result in all associated accounts being terminated.

4. Profile & Content Rules

When creating or updating your profile and when sending messages, you agree that all content:

• Is truthful, accurate, and not misleading.
• Does not impersonate another person or entity.
• Is not obscene, offensive, defamatory, or discriminatory based on caste, religion, gender, or any other protected characteristic.
• Does not contain spam, advertisements, or solicitations for any commercial purpose unrelated to matrimony.
• Does not include contact details (phone, email, social handles) on your public profile beyond what our privacy settings permit.
• Does not violate any third-party intellectual property rights.
• Complies with all applicable Indian laws and regulations.

By uploading photos or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating the Platform.

5. Prohibited Conduct

You must not:

• Harass, stalk, threaten, or intimidate any other member.
• Request money, bank details, or financial assistance from other members.
• Attempt to defraud or deceive other members in any way.
• Use the Platform for any illegal activity, including but not limited to trafficking, child exploitation, or fraud.
• Scrape, crawl, or extract data from the Platform without our written permission.
• Use automated tools, bots, or scripts to interact with the Platform.
• Reverse-engineer, decompile, or attempt to access the source code of our Platform.
• Attempt to circumvent any security measure or access restriction.
• Share login credentials or allow any other person to use your account.
• Post content that promotes dowry, caste-based discrimination, or any practice that is illegal under Indian law.

6. Premium Plans & Payments

6.1 Plan Tiers

We offer Free, Silver, Gold, and Platinum membership plans. Features vary by tier as described on our Plans page. We reserve the right to modify plan features and pricing with 30 days' notice.

6.2 Billing

Payments are processed securely through our payment gateway partners (e.g., Razorpay, PayU). By subscribing, you authorise us to charge the applicable fees to your chosen payment method on a recurring basis (monthly or annually, as selected).

6.3 Refund Policy

We offer a 7-day refund policy from the date of first purchase of any paid plan, provided you have not used premium-only features extensively. Refunds are at our discretion for renewals. Contact billing@subhmangalmilan.com for refund requests.

6.4 Cancellation

You may cancel your subscription at any time from Account Settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days after the 7-day window.

6.5 Taxes

All prices are inclusive of applicable GST unless stated otherwise. You are responsible for any additional taxes applicable in your jurisdiction.

7. Intellectual Property

All content on the Platform — including the logo, design, code, algorithms, text, graphics, and data compilations — is owned by or licensed to Subh Mangal Milan Pvt. Ltd. and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranty, express or implied, that:

• The Platform will be uninterrupted, error-free, or free of viruses.
• Any profile information provided by members is accurate or complete.
• Use of the Platform will result in a successful matrimonial match.
• The Platform will meet your specific requirements.

We are a platform connecting individuals; we do not conduct independent background checks on members. You are solely responsible for verifying the credentials, character, and suitability of any person you choose to interact with.

9. Limitation of Liability

To the maximum extent permitted by law, Subh Mangal Milan Pvt. Ltd. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of profit, or personal injury.

Our total aggregate liability to you for any claim relating to the Platform shall not exceed the amount you paid us in the 12 months immediately preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Subh Mangal Milan Pvt. Ltd. and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or access to the Platform.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any content you submit or transmit through the Platform.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Breach of these Terms.
• Conduct that is harmful to other members or the Platform.
• Fraudulent activity or misrepresentation.
• Receipt of valid complaints from other members.
• Legal or regulatory requirements.

You may delete your account at any time from Account Settings. Upon termination, your right to use the Platform ceases immediately. Sections 7, 9, 10, and 12 survive any termination.

12. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in New Delhi under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English.

Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email and a Platform notice at least 15 days before taking effect. Your continued use of the Platform after that date constitutes acceptance of the revised Terms.
